GIVEAWAY RULES WITH PURCHASE REQUIREMENT
ARTICLE 1 – Purpose of the rules
These Rules aim to organize the modalities of the contest (hereinafter the “Contest”) organized by UTOPIE CLUB, a sole proprietorship managed by Mr. Guillaume DAURELLE, registered with the Trade and Companies Register of Tarascon under number 930 020 763, with its registered office located at 117 Avenue Alphonse Daudet, 13160 Châteaurenard, France (hereinafter the “Organizer”).
This Contest is intended for any consumer making a purchase on the UTOPIE CLUB website: utopieclub.com.
ARTICLE 2 – Purpose of the Prize Draw
As part of the promotion of its clothing collections and its universe around travel and adventure, the Organiser is running a random draw giving the chance to win a trip to accompany the UTOPIE CLUB team on its next adventure, planned for 2027 (the “Prize”).
ARTICLE 3 – Duration, eligible orders and participants
3.1 Duration of the Operation :
The Prize Draw runs from 1 November 2026 to 2 January 2027 at 11:59 p.m. inclusive, Paris time (the “Duration”).
The random draw will take place on Sunday 3 January 2027 at 6:00 p.m., Paris time, in accordance with Article 6. If the stock of items in the collection sells out before 2 January 2027 at 11:59 p.m., the Prize Draw will end on the date and at the time the stock sells out, and the random draw will be brought forward: it will take place no later than seven (7) days after that date, at a date and time announced without delay on the Website and on Instagram.
3.2 Eligible orders :
Eligible orders are those confirmed on the Website and for which payment has been accepted (including payment in instalments):
from 4 February 2026 (the launch date of the Costa Rica collection), including orders placed before the launch of this Prize Draw;
until 2 January 2027 at 11:59 p.m., Paris time, or until the early closing provided for in Article 3.1.
Orders placed free of charge (complimentary products) are not eligible.
3.3 Participants :
The Prize Draw is open to any natural person who is at least 18 years old and of legal age under the law of their country of residence, residing in France or abroad, in one of the countries to which the Organiser delivers its products. Each Participant remains responsible for complying with the laws of their country of residence: their entry is void where those laws prohibit it.
The following are excluded: the Organiser; members of their family (spouse, parents and other ascendants, children and other descendants, brothers and sisters); persons contractually bound to the Organiser for the organisation or promotion of the Prize Draw (service providers, paid content creators); and members of those persons’ families.
Any entry by a minor is void.
ARTICLE 4 – CONDITIONS OF PARTICIPATION
Any Participant who meets the conditions of Article 3 may take part by purchasing one or more items on the Website, with no minimum amount. Purchasing at least one item on the Website is the only way to take part.
Each item purchased counts as one separate entry, including where the items are identical. The number of entries equals the number of items purchased.
Registration for the draw is automatic once the order is confirmed. No further action is required.
Entries are personal and registered in the name of the person who placed the order, subject to Article 5.5.
Entries linked to an order that is cancelled, refunded or returned before the random draw are removed.
In the event of a partial return of an order, only the entries corresponding to the returned items will be cancelled. Entries associated with the items kept will be maintained.
For example, if an order contains three items and only one is returned, only the entry linked to that item will be removed. The other two entries will remain valid.
ARTICLE 5 – The Prize
5.1 Description of the Prize :
The Prize Draw has a single Prize. It consists of a trip for one person, intended to allow the Winner to accompany the UTOPIE CLUB team on its next adventure, as part of the brand’s travel and content-creation project.
The exact destination and dates will be communicated to the Winner as soon as they are confirmed, and no later than six (6) weeks before departure.
The stay lasts at least seven (7) nights on site.
The trip will take place in 2027, and no later than 31 December 2027.
The commercial value of the Prize is estimated at €1,500 including VAT, for information only. The Organiser is committed to the services described in Article 5.2, not to that amount.
The Prize is personal. It may not be sold, exchanged or converted into cash, except as provided in Article 5.5 or where mandatory law provides otherwise. The Winner is under no obligation to appear in the Organiser’s content (Article 9).
5.2 Services included and costs not included :
The Prize includes the following only:
Return economy-class air travel, fully paid for by the Organiser. The departure airport will be chosen by the Organiser, taking into account the Winner’s place of residence and the available transport options. The Organiser will pay the full price of the ticket selected, as well as the standard baggage allowance included in it.
Accommodation for at least seven (7) nights, as part of the stay organised with the UTOPIE CLUB team (the type and conditions of accommodation, including any room sharing, are determined by the Organiser).
Local transfers needed for the group programme.
Meals expressly included in the official programme of the stay.
Activities organised by the Organiser as part of this adventure.
The following remain the Winner’s sole responsibility:
transport between their home and the departure airport, outbound and return;
travel, cancellation and repatriation insurance;
visa, passport and vaccination costs and other administrative or health formalities;
meals and drinks not included in the official programme;
personal expenses (purchases, souvenirs, individual activities);
optional excursions and extras not organised or not covered by the Organiser;
additional nights and any costs resulting from a stay extended at their initiative.
The final list of services will be communicated to the Winner before booking. Any service not expressly stated as included remains at the Winner’s expense.
5.3 Setting the travel dates :
The travel dates will be set taking into account the Winner’s availability and the provisional schedule of the adventure organised by the Organiser.
After the Winner is announced, the Organiser will contact the Winner to discuss their availability and will use its best efforts to find dates that suit the Winner.
However, the final dates remain subject to the organisational constraints of the trip, in particular the availability of the team and of service providers, and transport and accommodation conditions.
If no date can be found that is compatible with both the Winner’s availability and the schedule of the adventure, or if the Winner is ultimately unable to take part on the dates chosen, the Winner will be deemed to have waived the Prize. The Organiser may then contact the first reserve winner, then the following ones in the order of the random draw, as provided in Article 6 of these rules.
5.4 Modification or unavailability of the Prize : In the event of exceptional circumstances beyond the Organiser’s control (cancellation of transport, unavailability of accommodation, travel restrictions, or an event making the stay impossible or dangerous), the Organiser may adapt the practical arrangements of the trip and will offer a replacement solution of a value and characteristics as close as possible.
If the Organiser cancels or postpones the trip beyond 31 December 2027, it will offer the Winner a replacement trip of equivalent value and characteristics, on dates agreed together. Failing agreement, the Winner will receive compensation of a value equivalent to that of the Prize.
No change may arbitrarily deprive the Winner of the announced Prize.
5.5 Naming a beneficiary :
The Winner may name another natural person to receive the Prize, subject to the Organiser’s prior approval.
The named beneficiary must be of legal age, meet the eligibility conditions of Article 3.3 of these rules and accept all of their provisions. If they wish to appear in the Organiser’s content, they must also sign the authorisation provided for in Article 9. This authorisation is optional, and a refusal to sign it can in no circumstances call into question the award of the Prize.
The nomination must be notified to the Organiser within fifteen (15) days of notification of the win. If no nomination is made within that period, the Prize will remain with the Winner.
If the named beneficiary refuses, or does not meet the conditions of this Article, the Winner may name another beneficiary, subject to the Organiser’s approval. If no valid nomination is made, the Winner will keep the benefit of the Prize.
5.6 Conditions for travelling :
The traveller (the Winner or the named beneficiary) must:
be of legal age on the day of departure;
hold valid travel documents and complete, at their own expense, all necessary formalities;
be covered by travel, cancellation and repatriation insurance, and provide proof of it on request before booking;
behave in a way that is compatible with group life and everyone’s safety.
The Organiser may exclude a traveller whose behaviour endangers their own safety or that of others, or who does not meet these conditions. In that case, the Prize will be awarded to the next reserve winner.
ARTICLE 6 – Selection of the Winner
The random draw will take place on Sunday 3 January 2027 at 6:00 p.m. (Paris time), or on the earlier date provided for in Article 3.1, under the supervision of the Organiser. It will be carried out using an electronic random-draw tool, from among all valid entries. Each entry has the same probability of being drawn. The draw will be recorded.
The winner (the “Winner”) and three (3) reserve winners will be selected, ranked in the order in which they are drawn.
If the Winner waives the Prize, does not reply within the period set in Article 7, or does not meet the conditions for participation or travel, the Prize will be awarded to the first reserve winner, then to the second and the third, on the same terms. If none of them accepts, the Organiser may hold a new draw.
The Organiser will check the eligibility of the persons drawn. Any ineligible person will be replaced in the order of the reserve winners.
ARTICLE 7 – NOTIFICATION OF WINNERS
The Winner will be notified within twenty-four (24) hours after the draw, by email at the address provided when the order was placed and, where applicable, by Instagram direct message.
If the Winner does not reply within fifteen (15) days from the date the message is sent, they will be deemed to have waived the Prize, which will be awarded to the next reserve winner.
Persons who are not drawn will not be notified individually.
The Winner’s name may be announced on Instagram as their first name and the initial of their surname, or as their username, at the Winner’s choice. If they prefer to remain anonymous, the Organiser will announce only that the Winner has been contacted.
ARTICLE 8 – Delivery of the Prize and organisation of the trip
Within twenty-four (24) hours after the draw, the Organiser will contact the Winner to announce their win and arrange a phone or video call. This call will be used to define, together with the Winner, the length of the stay, the dates, the departure airport and the transport and accommodation arrangements. The Organiser will ask the Winner at that time for the information needed to make the bookings.
Transport and accommodation documents will be sent to the Winner within a reasonable time after they are booked, subject to the availability and constraints of the providers concerned.
ARTICLE 9 – Image rights
The trip is part of a content-creation project, but the Winner is under no obligation to appear in the Organiser’s content. Their privacy and comfort come first. They will be photographed or filmed only with their consent and may refuse at any time, including during the stay.
No image showing the Winner will be used before a separate authorisation licensing the use of their image (an image-rights release) has been signed. That authorisation will specify:
the purposes: communication and promotion of UTOPIE CLUB (website, social media, advertising, press);
the term: five (5) years from signature;
the territory: worldwide;
that the licence is granted free of charge, independently of the award of the Prize.
No use may harm their dignity, reputation or privacy. A refusal to appear or to sign this authorisation has no effect on the award of the Prize.
ARTICLE 10 – Liability
The Organiser is not liable for delays, cancellations or failures of third-party providers (airlines, accommodation providers, carriers), to the extent permitted by law. Nor can it be held liable for an inability to take part due to a malfunction of the Internet, the Website or the Instagram platform.
Nothing in these rules excludes or limits the Organiser’s liability for fraud or wilful misconduct, gross negligence or personal injury, or in any case where the law prohibits it.
ARTICLE 11 – Acceptance of the rules and of the General Terms and Conditions of Sale
Taking part implies full and unreserved acceptance of these rules and of the Organiser’s General Terms and Conditions of Sale, available on the Website.
ARTICLE 12 – Modification, suspension or cancellation
The Organiser may amend, postpone, suspend or cancel all or part of the Prize Draw in the event of force majeure or for a legitimate reason (technical reasons, fraud, legal obligation). It will inform Participants on the Website and on Instagram.
Such measures cannot affect the acquired rights of Participants. Orders already placed remain governed by the General Terms and Conditions of Sale.
ARTICLE 13 – Access to the rules
These rules are available free of charge on the Website, https://utopieclub.com, and will be sent free of charge to anyone who requests them by email at contact@utopieclub.com. They are written in French; an English translation may be made available for information only, and the French version prevails in the event of any discrepancy.
ARTICLE 14 – Fraud and exclusion
In the event of established fraud or attempted fraud (for example, multiple accounts or fictitious orders), the Organiser may exclude the Participant(s) concerned, without prejudice to any legal action.
ARTICLE 15 – Personal data
The Organiser is the data controller for the personal data collected for the Prize Draw and complies with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and the French Act of 6 January 1978 (Loi Informatique et Libertés), as amended.
Purposes: managing entries, the random draw, notifying the Winner, organising and delivering the Prize, and announcing the Winner.
Recipients: the Organiser and its processors necessary for the Prize Draw (Website host, payment providers and, for the Winner, transport and accommodation providers).
Retention: for non-winning Participants, data specific to the Prize Draw is deleted within three (3) months after the draw. For the Winner, it is kept until the end of the trip and then archived in accordance with legal obligations. Order data is kept in accordance with the General Terms and Conditions of Sale.
Rights: access, rectification, erasure, restriction, objection, portability, and withdrawal of consent at any time, by email to contact@utopieclub.com, stating the purpose of the request and, if necessary, proving their identity.
Complaints: to the CNIL, the French data protection authority, www.cnil.fr.
ARTICLE 16 – Governing law and dispute resolution
These rules are governed by French law, without prejudice to the mandatory consumer-protection provisions applicable in the Participant’s country of residence.
In the event of a dispute, a Participant who is a consumer must first send a written complaint to the Organiser at contact@utopieclub.com. If no satisfactory reply is received within ten (10) days, the Participant may use consumer mediation free of charge, within one year of their complaint, by applying to the E-commerce Mediator of FEVAD (Fédération du e-commerce et de la vente à distance), 60 rue de la Boétie, 75008 Paris, France, www.mediateurfevad.fr, mediateurduecommerce@fevad.com.
If mediation fails, or if the Participant does not wish to use it, the Participant may bring the matter before the competent courts.

RÈGLEMENT DU JEU-CONCOURS AVEC OBLIGATION D'ACHAT
ARTICLE 1 – Objet du reglement
Le présent règlement définit les modalités du jeu-concours avec obligation d’achat « UTOPIE CLUB EXPERIENCE — ÉDITION DE NOËL 2026 » (le « Jeu-Concours »), organisé par l’entreprise individuelle UTOPIE CLUB, exploitée par Monsieur Guillaume DAURELLE, immatriculée au registre du commerce et des sociétés de Tarascon sous le numéro 930 020 763, dont le siège est situé au 117 Avenue Alphonse Daudet, 13160 Châteaurenard, France (l’« Organisateur »).
Le Jeu-Concours se déroule sur le site Internet https://utopieclub.com (le « Site ») et est annoncé sur le compte Instagram utopie.club.
Le Jeu-Concours n’est ni géré, ni sponsorisé, ni associé à Instagram ou à Meta. Instagram et Meta ne peuvent être tenus responsables de son déroulement.
ARTICLE 2 – Objet du Jeu-Concours
Dans le cadre de la promotion de ses collections de vêtements et de son univers autour du voyage et de l’aventure, l’Organisateur organise un tirage au sort permettant de remporter un voyage pour accompagner l’équipe UTOPIE CLUB lors de sa prochaine aventure, prévue en 2027 (le « Lot »).
ARTICLE 3 – Durée, commandes éligibles et participants
3.1 Durée :
Le Jeu-Concours se déroule du 1er novembre 2026 au 2 janvier 2027 à 23h59 inclus, heure de Paris (la « Durée »).
Le tirage au sort a lieu le dimanche 3 janvier 2027 à 18h00, heure de Paris, selon les modalités de l’article 6. Si le stock des articles de la collection est épuisé avant le 2 janvier 2027 à 23h59, le Jeu-Concours prend fin à la date et à l’heure de l’épuisement du stock et le tirage au sort est avancé : il a lieu au plus tard sept (7) jours après cette date, à une date et une heure annoncées sans délai sur le Site et sur Instagram.
3.2 Commandes éligibles :
Sont éligibles les commandes validées dont le paiement a été accepté sur le Site (y compris en plusieurs fois) :
depuis le 4 février 2026 (date de lancement de la collection Costa Rica), y compris celles passées avant le lancement du présent Jeu-Concours ;
jusqu’au 2 janvier 2027 à 23h59, heure de Paris, ou jusqu’à la clôture anticipée prévue à l’article 3.1.
Les commandes passées à titre gratuit (produits offerts) ne sont pas éligibles.
3.3 Participants :
Le Jeu-Concours est ouvert à toute personne physique âgée d’au moins 18 ans et majeure selon la loi de son pays de résidence, résidant en France ou à l’étranger, dans l’un des pays où l’Organisateur livre ses produits. Chaque Participant reste responsable du respect de la législation de son pays de résidence : sa participation est nulle lorsque cette législation l’interdit.
Sont exclus : l’Organisateur, les membres de sa famille (conjoint, ascendants, descendants, frères et sœurs), ainsi que les personnes liées contractuellement à l’Organisateur pour l’organisation ou la promotion du Jeu-Concours (prestataires, créateurs de contenu rémunérés) et les membres de leur famille.
Toute participation d’une personne mineure est nulle.
ARTICLE 4 – Modalités de participation
Tout Participant remplissant les conditions de l’article 3 peut participer en achetant un ou plusieurs articles sur le Site, sans montant minimum. L’achat d’au moins un article sur le Site est la seule façon de participer.
Chaque article acheté équivaut à une participation distincte, y compris lorsque les articles sont identiques. Le nombre de participations est égal au nombre d’articles achetés.
L’inscription au tirage est automatique dès la validation de la commande. Aucune autre démarche n’est nécessaire.
La participation est nominative. Elle est attribuée à l’auteur de la commande, sous réserve de l’article 5.5.
Les participations liées à une commande annulée, remboursée ou retournée avant le tirage sont supprimées.
En cas de retour partiel d’une commande, seules les participations correspondant aux articles retournés seront annulées. Les participations associées aux articles conservés seront maintenues.
Par exemple, si une commande comprend trois articles et qu’un seul est retourné, seule la participation liée à cet article sera supprimée. Les deux autres participations resteront valables.
ARTICLE 5 – Lot mis en jeu
5.1 Description du lot :
Le Lot est unique. Il consiste en un voyage pour une personne, destiné à permettre au Gagnant d’accompagner l’équipe UTOPIE CLUB lors de sa prochaine aventure, dans le cadre du projet de voyage et de création de contenu de la marque.
La destination exacte et les dates sont communiquées au Gagnant dès leur confirmation, et au plus tard six (6) semaines avant le départ.
Le séjour dure au moins sept (7) nuits sur place.
Le voyage a lieu en 2027, et au plus tard le 31 décembre 2027.
La valeur commerciale du Lot est estimée à 1 500 € TTC, à titre indicatif. L’Organisateur s’engage sur les prestations décrites à l’article 5.2, et non sur ce montant.
Le Lot est personnel. Il ne peut être vendu, échangé ou converti en somme d’argent, sauf application de l’article 5.5 ou disposition légale impérative contraire. Le Gagnant n’a aucune obligation d’apparaître dans les contenus de l’Organisateur (article 9).
5.2 Prestations incluses et frais non inclus :
Le Lot comprend exclusivement :
Le transport aérien aller-retour en classe économique, intégralement pris en charge par l’Organisateur. L’aéroport de départ sera choisi par l’Organisateur, en tenant compte du lieu de résidence du gagnant et des possibilités de transport disponibles. L’Organisateur prendra en charge le prix total du billet retenu, ainsi que les bagages standards inclus dans celui-ci.
l’hébergement pendant au moins sept (7) nuits, dans le cadre du séjour organisé avec l’équipe UTOPIE CLUB (le type d’hébergement et ses conditions, notamment le partage éventuel de chambre, sont déterminés par l’Organisateur) ;
les transferts locaux nécessaires au programme collectif ;
les repas expressément prévus dans le programme officiel du séjour ;
les activités organisées par l’Organisateur dans le cadre de cette aventure.
Restent à la charge exclusive du Gagnant :
le transport entre son domicile et l’aéroport de départ, aller et retour ;
les assurances voyage, annulation et rapatriement ;
les frais de visa, passeport, vaccins et autres formalités administratives ou sanitaires ;
les repas et boissons non prévus au programme officiel ;
les dépenses personnelles (achats, souvenirs, activités individuelles) ;
les excursions et prestations facultatives non organisées ou non prises en charge par l’Organisateur ;
les nuits supplémentaires et tous frais liés à un séjour prolongé à son initiative.
La liste définitive des prestations est communiquée au Gagnant avant la réservation. Toute prestation non expressément mentionnée comme incluse reste à sa charge.
5.3 Fixation des dates du voyage :
Les dates du voyage seront déterminées en tenant compte des disponibilités du gagnant et du calendrier prévisionnel de l’aventure organisée par l’Organisateur.
Après l’annonce du gagnant, l’Organisateur prendra contact avec celui-ci afin d’échanger sur ses disponibilités et fera ses meilleurs efforts pour trouver des dates compatibles avec celles du gagnant.
Toutefois, les dates définitives resteront soumises aux contraintes d’organisation du voyage, notamment aux disponibilités de l’équipe, des prestataires et aux conditions de transport et d’hébergement.
Si aucune date compatible ne peut être trouvée entre les disponibilités du gagnant et le calendrier de l’aventure, ou si le gagnant ne peut finalement pas participer aux dates retenues, celui-ci sera considéré comme renonçant au lot. L’Organisateur pourra alors contacter le premier suppléant, puis les suivants dans l’ordre du tirage au sort, selon les modalités prévues à l’article 6 du présent règlement.
5.4 Modification ou indisponibilité du Lot : En cas de circonstances exceptionnelles indépendantes de la volonté de l’Organisateur (annulation d’un transport, indisponibilité d’un hébergement, restriction de voyage, événement rendant le séjour impossible ou dangereux), l’Organisateur peut adapter les modalités pratiques du voyage et propose une solution de remplacement de valeur et de caractéristiques aussi proches que possible.
Si l’Organisateur annule ou reporte le voyage au-delà du 31 décembre 2027, il propose au Gagnant un voyage de remplacement de valeur et de caractéristiques équivalentes, à des dates convenues ensemble. À défaut d’accord, le Gagnant reçoit une compensation d’une valeur équivalente à celle du Lot.
Aucune modification ne peut priver arbitrairement le Gagnant du Lot annoncé.
5.5 Désignation d’un bénéficiaire :
Le Gagnant peut désigner une autre personne physique pour bénéficier du Lot, sous réserve de l’accord préalable de l’Organisateur.
Le bénéficiaire désigné devra être majeur, remplir les conditions d’éligibilité prévues à l’article 3.3 du présent règlement et accepter l’ensemble de ses dispositions. S’il souhaite apparaître dans les contenus de l’Organisateur, il devra également signer l’autorisation prévue à l’article 9. Cette autorisation reste facultative et son refus ne pourra en aucun cas remettre en cause l’attribution du Lot.
La désignation devra être communiquée à l’Organisateur dans un délai de quinze (15) jours suivant la notification du gain. À défaut de désignation dans ce délai, le Lot restera attribué au Gagnant.
En cas de refus du bénéficiaire désigné ou si celui-ci ne remplit pas les conditions prévues au présent article, le Gagnant pourra désigner un autre bénéficiaire, sous réserve de l’accord de l’Organisateur. Si aucune désignation valable n’est effectuée, le Gagnant conservera le bénéfice du Lot.
5.6 Conditions pour partir :
Le voyageur (Gagnant ou bénéficiaire désigné) doit :
être majeur le jour du départ ;
disposer de documents de voyage valides et accomplir à ses frais toutes les formalités nécessaires ;
être couvert par une assurance voyage, annulation et rapatriement, dont il justifie sur demande avant la réservation ;
adopter un comportement compatible avec la vie de groupe et la sécurité de tous.
L’Organisateur peut écarter un voyageur dont le comportement met en danger sa sécurité ou celle d’autrui, ou qui ne remplit pas ces conditions. Dans ce cas, le Lot est attribué au suppléant suivant.
ARTICLE 6 – Désignation du Gagnant
Le tirage au sort a lieu le dimanche 3 janvier 2027 à 18h00 (heure de Paris), ou à la date avancée prévue à l’article 3.1, sous la supervision de l’Organisateur. Il est réalisé au moyen d’un outil de tirage électronique aléatoire, parmi toutes les participations valides. Chaque participation a la même probabilité d’être tirée. Le tirage est enregistré.
Sont désignés le gagnant (le « Gagnant ») et trois (3) suppléants, classés dans l’ordre du tirage.
Si le Gagnant renonce, ne répond pas dans le délai de l’article 7, ou ne remplit pas les conditions de participation ou de voyage, le Lot est attribué au premier suppléant, puis au deuxième et au troisième, dans les mêmes conditions. Si aucun n’accepte, l’Organisateur peut procéder à un nouveau tirage.
L’Organisateur vérifie l’éligibilité des personnes tirées. Toute personne inéligible est remplacée dans l’ordre des suppléants.
ARTICLE 7 – Information du Gagnant
Le Gagnant est informé dans les vingt-quatre (24) heures suivant le tirage, par email à l’adresse renseignée lors de la commande et, le cas échéant, par message privé Instagram.
S’il ne répond pas dans un délai de quinze (15) jours à compter de l’envoi du message, il est considéré comme ayant renoncé au Lot, qui est attribué au suppléant suivant.
Les personnes non tirées ne sont pas informées individuellement.
Le nom du Gagnant peut être annoncé sur Instagram sous la forme de son prénom et de l’initiale de son nom, ou de son nom d’utilisateur, au choix du Gagnant. S’il préfère rester anonyme, l’Organisateur annonce seulement que le Gagnant a été contacté.
ARTICLE 8 – Remise du Lot et organisation du voyage
Dans les vingt-quatre (24) heures suivant le tirage, l’Organisateur contacte le Gagnant pour lui annoncer son gain et convenir d’un échange téléphonique ou en visio. Cet échange permet de définir, avec lui, la durée du séjour, les dates, l’aéroport de départ et les modalités de transport et d’hébergement. L’Organisateur lui demande à cette occasion les informations nécessaires aux réservations.
Les titres de transport et d’hébergement sont transmis au Gagnant dans un délai raisonnable après leur réservation, sous réserve de la disponibilité et des contraintes des prestataires concernés.
ARTICLE 9 –Droit à l’image
Le voyage s’inscrit dans un projet de création de contenu, mais le Gagnant n’a aucune obligation d’apparaître dans les contenus de l’Organisateur. Sa vie privée et son confort passent avant tout. Il n’est photographié ou filmé qu’avec son accord et peut refuser à tout moment, y compris pendant le séjour.
Aucune image le montrant n’est utilisée avant la signature d’une autorisation distincte de cession de son droit à l’image, qui précise :
les finalités : communication et promotion d’UTOPIE CLUB (site, réseaux sociaux, publicité, presse) ;
la durée : cinq (5) ans à compter de la signature ;
le territoire : monde entier ;
le caractère gratuit de la cession, indépendant de l’attribution du Lot.
Aucune utilisation ne doit porter atteinte à sa dignité, à sa réputation ou à sa vie privée. Le refus d’apparaître ou de signer cette autorisation n’a aucune incidence sur l’attribution du Lot.
ARTICLE 10 – Responsabilité
L’Organisateur n’est pas responsable des retards, annulations ou défaillances des prestataires tiers (compagnies aériennes, hébergeurs, transporteurs) dans la mesure permise par la loi. Il ne peut non plus être tenu responsable d’une impossibilité de participer due à un dysfonctionnement du réseau Internet, du Site ou de la plateforme Instagram.
Rien dans le présent règlement n’exclut ni ne limite la responsabilité de l’Organisateur en cas de dol, de faute lourde ou de dommage corporel, ni dans les cas où la loi l’interdit.
ARTICLE 11 – Acceptation du règlement et des conditions générales de vente
La participation implique l’acceptation pleine et entière du présent règlement et des Conditions Générales de Vente de l’Organisateur, accessibles sur le Site.
ARTICLE 12 – Modification, suspension ou annulation
L’Organisateur peut modifier, reporter, suspendre ou annuler tout ou partie du Jeu-Concours en cas de force majeure ou pour un motif légitime (raison technique, fraude, obligation légale). Il en informe les Participants sur le Site et sur Instagram.
Ces mesures ne peuvent pas porter atteinte aux droits acquis des Participants. Les commandes passées restent régies par les Conditions Générales de Vente.
ARTICLE 13 – Consultation du règlement
Le présent règlement est consultable gratuitement sur le Site, https://utopieclub.com, et adressé gratuitement à toute personne qui en fait la demande par email à contact@utopieclub.com. Il est rédigé en français ; une traduction en anglais peut être mise à disposition à titre informatif, la version française prévalant en cas de divergence.
ARTICLE 14 – Fraude et exclusion
En cas de fraude ou de tentative de fraude constatée (par exemple multiples comptes ou commandes fictives), l’Organisateur peut exclure le ou les Participants concernés, sans préjudice de poursuites éventuelles.
ARTICLE 15 – Données personnelles
L’Organisateur est responsable du traitement des données collectées pour le Jeu-Concours, dans le respect du règlement (UE) 2016/679 (RGPD) et de la loi du 6 janvier 1978 modifiée.
Finalités : gestion de la participation, tirage au sort, information du Gagnant, organisation et remise du Lot, annonce du Gagnant.
Destinataires : l’Organisateur et ses sous-traitants nécessaires au Jeu-Concours (hébergeur du Site, outils de paiement et, pour le Gagnant, prestataires de transport et d’hébergement).
Conservation : pour les Participants non gagnants, les données propres au Jeu-Concours sont supprimées dans les trois (3) mois suivant le tirage. Pour le Gagnant, elles sont conservées jusqu’à la fin du voyage, puis archivées selon les obligations légales. Les données de commande sont conservées conformément aux Conditions Générales de Vente.
Droits : accès, rectification, effacement, limitation, opposition, portabilité, et retrait du consentement à tout moment, par email à contact@utopieclub.com, en précisant l’objet de la demande et en justifiant de son identité si nécessaire.
Réclamation : auprès de la CNIL, www.cnil.fr.
ARTICLE 16 – Loi applicable et règlement des litiges
Le présent règlement est soumis au droit français, sans préjudice des dispositions impératives de protection des consommateurs applicables dans le pays de résidence du Participant.
En cas de litige, le Participant consommateur adresse d’abord une réclamation écrite à l’Organisateur à contact@utopieclub.com. En l’absence de réponse satisfaisante sous dix (10) jours, il peut recourir gratuitement à la médiation de la consommation, dans le délai d’un an à compter de sa réclamation, auprès du Médiateur du e-commerce de la FEVAD, 60 rue de la Boétie, 75008 Paris, www.mediateurfevad.fr, mediateurduecommerce@fevad.com.
En cas d’échec de la médiation, ou s’il ne souhaite pas y recourir, le Participant peut saisir les tribunaux compétents.
GIVEAWAY RULES WITH PURCHASE REQUIREMENT
ARTICLE 1 – PURPOSE OF THE RULES
These Rules aim to organize the modalities of the contest (hereinafter the “Contest”) organized by UTOPIE CLUB, a sole proprietorship managed by Mr. Guillaume DAURELLE, registered with the Trade and Companies Register of Tarascon under number 930 020 763, with its registered office located at 117 Avenue Alphonse Daudet, 13160 Châteaurenard, France (hereinafter the “Organizer”).
This Contest is intended for any consumer making a purchase on the UTOPIE CLUB website: utopieclub.com.
ARTICLE 2 – PURPOSE OF THE PRIZE DRAW
As part of the promotion of its clothing collections and its world built around travel and adventure, the Organizer is holding a prize draw offering the opportunity to win a trip accompanying the UTOPIE CLUB team on its next adventure, planned for 2027 (the “Prize”).
ARTICLE 3 – DURATION, ELIGIBLE ORDERS AND PARTICIPANTS
3.1 Duration : The Prize Draw runs from 1 November 2026 to 2 January 2027 at 11:59 p.m. inclusive, Paris time (the “Duration”).
The random draw will take place on Sunday 3 January 2027 at 6:00 p.m., Paris time, in accordance with Article 6. If the stock of items in the collection sells out before 2 January 2027 at 11:59 p.m., the Prize Draw will end on the date and at the time the stock sells out, and the random draw will be brought forward: it will take place no later than seven (7) days after that date, at a date and time announced without delay on the Website and on Instagram.
3.2 Eligible orders : Eligible orders are those confirmed on the Website and for which payment has been accepted (including payment in instalments):
from 4 February 2026 (the launch date of the Costa Rica collection), including orders placed before the launch of this Prize Draw;
until 2 January 2027 at 11:59 p.m., Paris time, or until the early closing provided for in Article 3.1.
Orders placed free of charge (complimentary products) are not eligible.
3.3 Participants : The Prize Draw is open to any natural person who is at least 18 years old and of legal age under the law of their country of residence, residing in France or abroad, in one of the countries to which the Organiser delivers its products. Each Participant remains responsible for complying with the laws of their country of residence: their entry is void where those laws prohibit it.
The following are excluded: the Organiser; members of their family (spouse, parents and other ascendants, children and other descendants, brothers and sisters); persons contractually bound to the Organiser for the organisation or promotion of the Prize Draw (service providers, paid content creators); and members of those persons’ families.
Any entry by a minor is void.
ARTICLE 4 – CONDITIONS OF PARTICIPATION
Any Participant who meets the conditions of Article 3 may take part by purchasing one or more items on the Website, with no minimum amount. Purchasing at least one item on the Website is the only way to take part.
Each item purchased counts as one separate entry, including where the items are identical. The number of entries equals the number of items purchased.
Registration for the draw is automatic once the order is confirmed. No further action is required.
Entries are personal and registered in the name of the person who placed the order, subject to Article 5.5.
Entries linked to an order that is cancelled, refunded or returned before the random draw are removed.
In the event of a partial return of an order, only the entries corresponding to the returned items will be cancelled. Entries associated with the items kept will be maintained.
For example, if an order contains three items and only one is returned, only the entry linked to that item will be removed. The other two entries will remain valid.
ARTICLE 5 – PRIZES
5.1 Description of Prizes :
The Prize Draw has a single Prize. It consists of a trip for one person, intended to allow the Winner to accompany the UTOPIE CLUB team on its next adventure, as part of the brand’s travel and content-creation project.
The exact destination and dates will be communicated to the Winner as soon as they are confirmed, and no later than six (6) weeks before departure.
The stay lasts at least seven (7) nights on site.
The trip will take place in 2027, and no later than 31 December 2027.
The commercial value of the Prize is estimated at €1,500 including VAT, for information only. The Organiser is committed to the services described in Article 5.2, not to that amount.
The Prize is personal. It may not be sold, exchanged or converted into cash, except as provided in Article 5.5 or where mandatory law provides otherwise. The Winner is under no obligation to appear in the Organiser’s content (Article 9).
5.2 Services included and costs not included :
The Prize includes the following only:
Return economy-class air travel, fully paid for by the Organiser. The departure airport will be chosen by the Organiser, taking into account the Winner’s place of residence and the available transport options. The Organiser will pay the full price of the ticket selected, as well as the standard baggage allowance included in it.
Accommodation for at least seven (7) nights, as part of the stay organised with the UTOPIE CLUB team (the type and conditions of accommodation, including any room sharing, are determined by the Organiser).
Local transfers needed for the group programme.
Meals expressly included in the official programme of the stay.
Activities organised by the Organiser as part of this adventure.
The following remain the Winner’s sole responsibility: transport between their home and the departure airport, outbound and return; travel, cancellation and repatriation insurance; visa, passport and vaccination costs and other administrative or health formalities; meals and drinks not included in the official programme; personal expenses (purchases, souvenirs, individual activities); optional excursions and extras not organised or not covered by the Organiser; additional nights and any costs resulting from a stay extended at their initiative. The final list of services will be communicated to the Winner before booking. Any service not expressly stated as included remains at the Winner’s expense.
The following remain the Winner’s sole responsibility: transport between their home and the departure airport, outbound and return; travel, cancellation and repatriation insurance; visa, passport and vaccination costs and other administrative or health formalities; meals and drinks not included in the official programme; personal expenses (purchases, souvenirs, individual activities); optional excursions and extras not organised or not covered by the Organiser; additional nights and any costs resulting from a stay extended at their initiative. 5.3 Setting the travel dates :
The travel dates will be set taking into account the Winner’s availability and the provisional schedule of the adventure organised by the Organiser.
After the Winner is announced, the Organiser will contact the Winner to discuss their availability and will use its best efforts to find dates that suit the Winner.
However, the final dates remain subject to the organisational constraints of the trip, in particular the availability of the team and of service providers, and transport and accommodation conditions.
If no date can be found that is compatible with both the Winner’s availability and the schedule of the adventure, or if the Winner is ultimately unable to take part on the dates chosen, the Winner will be deemed to have waived the Prize. The Organiser may then contact the first reserve winner, then the following ones in the order of the random draw, as provided in Article 6 of these rules.
5.4 Modification or unavailability of the Prize :
In the event of exceptional circumstances beyond the Organiser’s control (cancellation of transport, unavailability of accommodation, travel restrictions, or an event making the stay impossible or dangerous), the Organiser may adapt the practical arrangements of the trip and will offer a replacement solution of a value and characteristics as close as possible.
If the Organiser cancels or postpones the trip beyond 31 December 2027, it will offer the Winner a replacement trip of equivalent value and characteristics, on dates agreed together. Failing agreement, the Winner will receive compensation of a value equivalent to that of the Prize.
No change may arbitrarily deprive the Winner of the announced Prize.
5.5 Naming a beneficiary :
The Winner may name another natural person to receive the Prize, subject to the Organiser’s prior approval.
The named beneficiary must be of legal age, meet the eligibility conditions of Article 3.3 of these rules and accept all of their provisions. If they wish to appear in the Organiser’s content, they must also sign the authorisation provided for in Article 9. This authorisation is optional, and a refusal to sign it can in no circumstances call into question the award of the Prize.
The nomination must be notified to the Organiser within fifteen (15) days of notification of the win. If no nomination is made within that period, the Prize will remain with the Winner.
If the named beneficiary refuses, or does not meet the conditions of this Article, the Winner may name another beneficiary, subject to the Organiser’s approval. If no valid nomination is made, the Winner will keep the benefit of the Prize.
5.6 Conditions for travelling :
The traveller (the Winner or the named beneficiary) must:
be of legal age on the day of departure;
hold valid travel documents and complete, at their own expense, all necessary formalities;
be covered by travel, cancellation and repatriation insurance, and provide proof of it on request before booking;
behave in a way that is compatible with group life and everyone’s safety.
The Organiser may exclude a traveller whose behaviour endangers their own safety or that of others, or who does not meet these conditions. In that case, the Prize will be awarded to the next reserve winner.
ARTICLE 6 – DESIGNATION OF WINNERS
The random draw will take place on Sunday 3 January 2027 at 6:00 p.m. (Paris time), or on the earlier date provided for in Article 3.1, under the supervision of the Organiser. It will be carried out using an electronic random-draw tool, from among all valid entries. Each entry has the same probability of being drawn. The draw will be recorded.
The winner (the “Winner”) and three (3) reserve winners will be selected, ranked in the order in which they are drawn.
If the Winner waives the Prize, does not reply within the period set in Article 7, or does not meet the conditions for participation or travel, the Prize will be awarded to the first reserve winner, then to the second and the third, on the same terms. If none of them accepts, the Organiser may hold a new draw.
The Organiser will check the eligibility of the persons drawn. Any ineligible person will be replaced in the order of the reserve winners.
ARTICLE 7 – NOTIFICATION OF WINNERS
The Winner will be notified within twenty-four (24) hours after the draw, by email at the address provided when the order was placed and, where applicable, by Instagram direct message.
If the Winner does not reply within fifteen (15) days from the date the message is sent, they will be deemed to have waived the Prize, which will be awarded to the next reserve winner.
Persons who are not drawn will not be notified individually.
The Winner’s name may be announced on Instagram as their first name and the initial of their surname, or as their username, at the Winner’s choice. If they prefer to remain anonymous, the Organiser will announce only that the Winner has been contacted.
ARTICLE 8 – Delivery of the Prize and organisation of the trip
Within twenty-four (24) hours after the draw, the Organiser will contact the Winner to announce their win and arrange a phone or video call. This call will be used to define, together with the Winner, the length of the stay, the dates, the departure airport and the transport and accommodation arrangements. The Organiser will ask the Winner at that time for the information needed to make the bookings.
Transport and accommodation documents will be sent to the Winner within a reasonable time after they are booked, subject to the availability and constraints of the providers concerned.
ARTICLE 9 – Image rights
The trip is part of a content-creation project, but the Winner is under no obligation to appear in the Organiser’s content. Their privacy and comfort come first. They will be photographed or filmed only with their consent and may refuse at any time, including during the stay.
No image showing the Winner will be used before a separate authorisation licensing the use of their image (an image-rights release) has been signed. That authorisation will specify:
the purposes: communication and promotion of UTOPIE CLUB (website, social media, advertising, press);
the term: five (5) years from signature;
the territory: worldwide;
that the licence is granted free of charge, independently of the award of the Prize.
No use may harm their dignity, reputation or privacy. A refusal to appear or to sign this authorisation has no effect on the award of the Prize.
ARTICLE 10 – Liability
The Organiser is not liable for delays, cancellations or failures of third-party providers (airlines, accommodation providers, carriers), to the extent permitted by law. Nor can it be held liable for an inability to take part due to a malfunction of the Internet, the Website or the Instagram platform.
Nothing in these rules excludes or limits the Organiser’s liability for fraud or wilful misconduct, gross negligence or personal injury, or in any case where the law prohibits it.
ARTICLE 11 – Acceptance of the rules and of the General Terms and Conditions of Sale
Taking part implies full and unreserved acceptance of these rules and of the Organiser’s General Terms and Conditions of Sale, available on the Website.
ARTICLE 12 – Modification, suspension or cancellation
The Organiser may amend, postpone, suspend or cancel all or part of the Prize Draw in the event of force majeure or for a legitimate reason (technical reasons, fraud, legal obligation). It will inform Participants on the Website and on Instagram.
Such measures cannot affect the acquired rights of Participants. Orders already placed remain governed by the General Terms and Conditions of Sale.
ARTICLE 13 – Access to the rules
These rules are available free of charge on the Website, https://utopieclub.com, and will be sent free of charge to anyone who requests them by email at contact@utopieclub.com. They are written in French; an English translation may be made available for information only, and the French version prevails in the event of any discrepancy.
ARTICLE 14 – Fraud and exclusion
In the event of established fraud or attempted fraud (for example, multiple accounts or fictitious orders), the Organiser may exclude the Participant(s) concerned, without prejudice to any legal action.
ARTICLE 15 – Personal data
The Organiser is the data controller for the personal data collected for the Prize Draw and complies with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and the French Act of 6 January 1978 (Loi Informatique et Libertés), as amended.
Purposes: managing entries, the random draw, notifying the Winner, organising and delivering the Prize, and announcing the Winner.
Recipients: the Organiser and its processors necessary for the Prize Draw (Website host, payment providers and, for the Winner, transport and accommodation providers).
Retention: for non-winning Participants, data specific to the Prize Draw is deleted within three (3) months after the draw. For the Winner, it is kept until the end of the trip and then archived in accordance with legal obligations. Order data is kept in accordance with the General Terms and Conditions of Sale.
Rights: access, rectification, erasure, restriction, objection, portability, and withdrawal of consent at any time, by email to contact@utopieclub.com, stating the purpose of the request and, if necessary, proving their identity.
Complaints: to the CNIL, the French data protection authority, www.cnil.fr.
ARTICLE 16 – Governing law and dispute resolution
These rules are governed by French law, without prejudice to the mandatory consumer-protection provisions applicable in the Participant’s country of residence.
In the event of a dispute, a Participant who is a consumer must first send a written complaint to the Organiser at contact@utopieclub.com. If no satisfactory reply is received within ten (10) days, the Participant may use consumer mediation free of charge, within one year of their complaint, by applying to the E-commerce Mediator of FEVAD (Fédération du e-commerce et de la vente à distance), 60 rue de la Boétie, 75008 Paris, France, www.mediateurfevad.fr, mediateurduecommerce@fevad.com.
If mediation fails, or if the Participant does not wish to use it, the Participant may bring the matter before the competent courts.
RÈGLEMENT DU JEU-CONCOURS AVEC OBLIGATION D'ACHAT
ARTICLE 1 – Objet du reglement
Le présent règlement définit les modalités du jeu-concours avec obligation d’achat « UTOPIE CLUB EXPERIENCE — ÉDITION DE NOËL 2026 » (le « Jeu-Concours »), organisé par l’entreprise individuelle UTOPIE CLUB, exploitée par Monsieur Guillaume DAURELLE, immatriculée au registre du commerce et des sociétés de Tarascon sous le numéro 930 020 763, dont le siège est situé au 117 Avenue Alphonse Daudet, 13160 Châteaurenard, France (l’« Organisateur »).
Le Jeu-Concours se déroule sur le site Internet https://utopieclub.com (le « Site ») et est annoncé sur le compte Instagram utopie.club.
Le Jeu-Concours n’est ni géré, ni sponsorisé, ni associé à Instagram ou à Meta. Instagram et Meta ne peuvent être tenus responsables de son déroulement.
ARTICLE 2 – Objet du Jeu-Concours
Dans le cadre de la promotion de ses collections de vêtements et de son univers autour du voyage et de l’aventure, l’Organisateur organise un tirage au sort permettant de remporter un voyage pour accompagner l’équipe UTOPIE CLUB lors de sa prochaine aventure, prévue en 2027 (le « Lot »).
ARTICLE 3 – Durée, commandes éligibles et participants
3.1 Durée : Le Jeu-Concours se déroule du 1er novembre 2026 au 2 janvier 2027 à 23h59 inclus, heure de Paris (la « Durée »).
Le tirage au sort a lieu le dimanche 3 janvier 2027 à 18h00, heure de Paris, selon les modalités de l’article 6. Si le stock des articles de la collection est épuisé avant le 2 janvier 2027 à 23h59, le Jeu-Concours prend fin à la date et à l’heure de l’épuisement du stock et le tirage au sort est avancé : il a lieu au plus tard sept (7) jours après cette date, à une date et une heure annoncées sans délai sur le Site et sur Instagram.
3.2 Commandes éligibles : Sont éligibles les commandes validées dont le paiement a été accepté sur le Site (y compris en plusieurs fois) :
depuis le 4 février 2026 (date de lancement de la collection Costa Rica), y compris celles passées avant le lancement du présent Jeu-Concours ;
jusqu’au 2 janvier 2027 à 23h59, heure de Paris, ou jusqu’à la clôture anticipée prévue à l’article 3.1.
Les commandes passées à titre gratuit (produits offerts) ne sont pas éligibles.
3.3 Participants : Le Jeu-Concours est ouvert à toute personne physique âgée d’au moins 18 ans et majeure selon la loi de son pays de résidence, résidant en France ou à l’étranger, dans l’un des pays où l’Organisateur livre ses produits. Chaque Participant reste responsable du respect de la législation de son pays de résidence : sa participation est nulle lorsque cette législation l’interdit.
Sont exclus : l’Organisateur, les membres de sa famille (conjoint, ascendants, descendants, frères et sœurs), ainsi que les personnes liées contractuellement à l’Organisateur pour l’organisation ou la promotion du Jeu-Concours (prestataires, créateurs de contenu rémunérés) et les membres de leur famille.
Toute participation d’une personne mineure est nulle.
ARTICLE 4 – Modalités de participation
Tout Participant remplissant les conditions de l’article 3 peut participer en achetant un ou plusieurs articles sur le Site, sans montant minimum. L’achat d’au moins un article sur le Site est la seule façon de participer.
Chaque article acheté équivaut à une participation distincte, y compris lorsque les articles sont identiques. Le nombre de participations est égal au nombre d’articles achetés.
L’inscription au tirage est automatique dès la validation de la commande. Aucune autre démarche n’est nécessaire.
La participation est nominative. Elle est attribuée à l’auteur de la commande, sous réserve de l’article 5.5.
Les participations liées à une commande annulée, remboursée ou retournée avant le tirage sont supprimées.
En cas de retour partiel d’une commande, seules les participations correspondant aux articles retournés seront annulées. Les participations associées aux articles conservés seront maintenues.
Par exemple, si une commande comprend trois articles et qu’un seul est retourné, seule la participation liée à cet article sera supprimée. Les deux autres participations resteront valables.
ARTICLE 5 – Lot mis en jeu
5.1 Description du lot :
Le Lot est unique. Il consiste en un voyage pour une personne, destiné à permettre au Gagnant d’accompagner l’équipe UTOPIE CLUB lors de sa prochaine aventure, dans le cadre du projet de voyage et de création de contenu de la marque.
La destination exacte et les dates sont communiquées au Gagnant dès leur confirmation, et au plus tard six (6) semaines avant le départ.
Le séjour dure au moins sept (7) nuits sur place.
Le voyage a lieu en 2027, et au plus tard le 31 décembre 2027.
La valeur commerciale du Lot est estimée à 1 500 € TTC, à titre indicatif. L’Organisateur s’engage sur les prestations décrites à l’article 5.2, et non sur ce montant.
Le Lot est personnel. Il ne peut être vendu, échangé ou converti en somme d’argent, sauf application de l’article 5.5 ou disposition légale impérative contraire. Le Gagnant n’a aucune obligation d’apparaître dans les contenus de l’Organisateur (article 9).
5.2 Prestations incluses et frais non inclus :
Le Lot comprend exclusivement :
Le transport aérien aller-retour en classe économique, intégralement pris en charge par l’Organisateur. L’aéroport de départ sera choisi par l’Organisateur, en tenant compte du lieu de résidence du gagnant et des possibilités de transport disponibles. L’Organisateur prendra en charge le prix total du billet retenu, ainsi que les bagages standards inclus dans celui-ci.
l’hébergement pendant au moins sept (7) nuits, dans le cadre du séjour organisé avec l’équipe UTOPIE CLUB (le type d’hébergement et ses conditions, notamment le partage éventuel de chambre, sont déterminés par l’Organisateur) ;
les transferts locaux nécessaires au programme collectif ;
les repas expressément prévus dans le programme officiel du séjour ;
les activités organisées par l’Organisateur dans le cadre de cette aventure.
Restent à la charge exclusive du Gagnant :
le transport entre son domicile et l’aéroport de départ, aller et retour ;
les assurances voyage, annulation et rapatriement ;
les frais de visa, passeport, vaccins et autres formalités administratives ou sanitaires ;
les repas et boissons non prévus au programme officiel ;
les dépenses personnelles (achats, souvenirs, activités individuelles) ;
les excursions et prestations facultatives non organisées ou non prises en charge par l’Organisateur ;
les nuits supplémentaires et tous frais liés à un séjour prolongé à son initiative.
La liste définitive des prestations est communiquée au Gagnant avant la réservation. Toute prestation non expressément mentionnée comme incluse reste à sa charge.
5.3 Fixation des dates du voyage :
Les dates du voyage seront déterminées en tenant compte des disponibilités du gagnant et du calendrier prévisionnel de l’aventure organisée par l’Organisateur.
Après l’annonce du gagnant, l’Organisateur prendra contact avec celui-ci afin d’échanger sur ses disponibilités et fera ses meilleurs efforts pour trouver des dates compatibles avec celles du gagnant.
Toutefois, les dates définitives resteront soumises aux contraintes d’organisation du voyage, notamment aux disponibilités de l’équipe, des prestataires et aux conditions de transport et d’hébergement.
Si aucune date compatible ne peut être trouvée entre les disponibilités du gagnant et le calendrier de l’aventure, ou si le gagnant ne peut finalement pas participer aux dates retenues, celui-ci sera considéré comme renonçant au lot. L’Organisateur pourra alors contacter le premier suppléant, puis les suivants dans l’ordre du tirage au sort, selon les modalités prévues à l’article 6 du présent règlement.
5.4 Modification ou indisponibilité du Lot
:
En cas de circonstances exceptionnelles indépendantes de la volonté de l’Organisateur (annulation d’un transport, indisponibilité d’un hébergement, restriction de voyage, événement rendant le séjour impossible ou dangereux), l’Organisateur peut adapter les modalités pratiques du voyage et propose une solution de remplacement de valeur et de caractéristiques aussi proches que possible.
Si l’Organisateur annule ou reporte le voyage au-delà du 31 décembre 2027, il propose au Gagnant un voyage de remplacement de valeur et de caractéristiques équivalentes, à des dates convenues ensemble. À défaut d’accord, le Gagnant reçoit une compensation d’une valeur équivalente à celle du Lot.
Aucune modification ne peut priver arbitrairement le Gagnant du Lot annoncé.
5.5 Désignation d’un bénéficiaire
:
Le Gagnant peut désigner une autre personne physique pour bénéficier du Lot, sous réserve de l’accord préalable de l’Organisateur.
Le bénéficiaire désigné devra être majeur, remplir les conditions d’éligibilité prévues à l’article 3.3 du présent règlement et accepter l’ensemble de ses dispositions. S’il souhaite apparaître dans les contenus de l’Organisateur, il devra également signer l’autorisation prévue à l’article 9. Cette autorisation reste facultative et son refus ne pourra en aucun cas remettre en cause l’attribution du Lot.
La désignation devra être communiquée à l’Organisateur dans un délai de quinze (15) jours suivant la notification du gain. À défaut de désignation dans ce délai, le Lot restera attribué au Gagnant.
En cas de refus du bénéficiaire désigné ou si celui-ci ne remplit pas les conditions prévues au présent article, le Gagnant pourra désigner un autre bénéficiaire, sous réserve de l’accord de l’Organisateur. Si aucune désignation valable n’est effectuée, le Gagnant conservera le bénéfice du Lot.
5.6 Conditions pour partir :
Le voyageur (Gagnant ou bénéficiaire désigné) doit :
être majeur le jour du départ ;
disposer de documents de voyage valides et accomplir à ses frais toutes les formalités nécessaires ;
être couvert par une assurance voyage, annulation et rapatriement, dont il justifie sur demande avant la réservation ;
adopter un comportement compatible avec la vie de groupe et la sécurité de tous.
L’Organisateur peut écarter un voyageur dont le comportement met en danger sa sécurité ou celle d’autrui, ou qui ne remplit pas ces conditions. Dans ce cas, le Lot est attribué au suppléant suivant.
ARTICLE 6 – Désignation du Gagnant
Le tirage au sort a lieu le dimanche 3 janvier 2027 à 18h00 (heure de Paris), ou à la date avancée prévue à l’article 3.1, sous la supervision de l’Organisateur. Il est réalisé au moyen d’un outil de tirage électronique aléatoire, parmi toutes les participations valides. Chaque participation a la même probabilité d’être tirée. Le tirage est enregistré.
Sont désignés le gagnant (le « Gagnant ») et trois (3) suppléants, classés dans l’ordre du tirage.
Si le Gagnant renonce, ne répond pas dans le délai de l’article 7, ou ne remplit pas les conditions de participation ou de voyage, le Lot est attribué au premier suppléant, puis au deuxième et au troisième, dans les mêmes conditions. Si aucun n’accepte, l’Organisateur peut procéder à un nouveau tirage.
L’Organisateur vérifie l’éligibilité des personnes tirées. Toute personne inéligible est remplacée dans l’ordre des suppléants.
ARTICLE 7 – Information du Gagnant
Le Gagnant est informé dans les vingt-quatre (24) heures suivant le tirage, par email à l’adresse renseignée lors de la commande et, le cas échéant, par message privé Instagram.
S’il ne répond pas dans un délai de quinze (15) jours à compter de l’envoi du message, il est considéré comme ayant renoncé au Lot, qui est attribué au suppléant suivant.
Les personnes non tirées ne sont pas informées individuellement.
Le nom du Gagnant peut être annoncé sur Instagram sous la forme de son prénom et de l’initiale de son nom, ou de son nom d’utilisateur, au choix du Gagnant. S’il préfère rester anonyme, l’Organisateur annonce seulement que le Gagnant a été contacté.
ARTICLE 8 – Remise du Lot et organisation du voyage
Dans les vingt-quatre (24) heures suivant le tirage, l’Organisateur contacte le Gagnant pour lui annoncer son gain et convenir d’un échange téléphonique ou en visio. Cet échange permet de définir, avec lui, la durée du séjour, les dates, l’aéroport de départ et les modalités de transport et d’hébergement. L’Organisateur lui demande à cette occasion les informations nécessaires aux réservations.
Les titres de transport et d’hébergement sont transmis au Gagnant dans un délai raisonnable après leur réservation, sous réserve de la disponibilité et des contraintes des prestataires concernés.
ARTICLE 9 – Droit à l’image
Le voyage s’inscrit dans un projet de création de contenu, mais le Gagnant n’a aucune obligation d’apparaître dans les contenus de l’Organisateur. Sa vie privée et son confort passent avant tout. Il n’est photographié ou filmé qu’avec son accord et peut refuser à tout moment, y compris pendant le séjour.
Aucune image le montrant n’est utilisée avant la signature d’une autorisation distincte de cession de son droit à l’image, qui précise :
les finalités : communication et promotion d’UTOPIE CLUB (site, réseaux sociaux, publicité, presse) ;
la durée : cinq (5) ans à compter de la signature ;
le territoire : monde entier ;
le caractère gratuit de la cession, indépendant de l’attribution du Lot.
Aucune utilisation ne doit porter atteinte à sa dignité, à sa réputation ou à sa vie privée. Le refus d’apparaître ou de signer cette autorisation n’a aucune incidence sur l’attribution du Lot.
ARTICLE 10 – Responsabilité
L’Organisateur n’est pas responsable des retards, annulations ou défaillances des prestataires tiers (compagnies aériennes, hébergeurs, transporteurs) dans la mesure permise par la loi. Il ne peut non plus être tenu responsable d’une impossibilité de participer due à un dysfonctionnement du réseau Internet, du Site ou de la plateforme Instagram.
Rien dans le présent règlement n’exclut ni ne limite la responsabilité de l’Organisateur en cas de dol, de faute lourde ou de dommage corporel, ni dans les cas où la loi l’interdit.
ARTICLE 11 – Acceptation du règlement et des conditions générales de vente
La participation implique l’acceptation pleine et entière du présent règlement et des Conditions Générales de Vente de l’Organisateur, accessibles sur le Site.
ARTICLE 12 – Modification, suspension ou annulation
L’Organisateur peut modifier, reporter, suspendre ou annuler tout ou partie du Jeu-Concours en cas de force majeure ou pour un motif légitime (raison technique, fraude, obligation légale). Il en informe les Participants sur le Site et sur Instagram.
Ces mesures ne peuvent pas porter atteinte aux droits acquis des Participants. Les commandes passées restent régies par les Conditions Générales de Vente.
ARTICLE 13 – Consultation du règlement
Le présent règlement est consultable gratuitement sur le Site, https://utopieclub.com, et adressé gratuitement à toute personne qui en fait la demande par email à contact@utopieclub.com. Il est rédigé en français ; une traduction en anglais peut être mise à disposition à titre informatif, la version française prévalant en cas de divergence.
ARTICLE 14 – Fraude et exclusion
En cas de fraude ou de tentative de fraude constatée (par exemple multiples comptes ou commandes fictives), l’Organisateur peut exclure le ou les Participants concernés, sans préjudice de poursuites éventuelles.
ARTICLE 15 – Données personnelles
L’Organisateur est responsable du traitement des données collectées pour le Jeu-Concours, dans le respect du règlement (UE) 2016/679 (RGPD) et de la loi du 6 janvier 1978 modifiée.
Finalités : gestion de la participation, tirage au sort, information du Gagnant, organisation et remise du Lot, annonce du Gagnant.
Destinataires : l’Organisateur et ses sous-traitants nécessaires au Jeu-Concours (hébergeur du Site, outils de paiement et, pour le Gagnant, prestataires de transport et d’hébergement).
Conservation : pour les Participants non gagnants, les données propres au Jeu-Concours sont supprimées dans les trois (3) mois suivant le tirage. Pour le Gagnant, elles sont conservées jusqu’à la fin du voyage, puis archivées selon les obligations légales. Les données de commande sont conservées conformément aux Conditions Générales de Vente.
Droits : accès, rectification, effacement, limitation, opposition, portabilité, et retrait du consentement à tout moment, par email à contact@utopieclub.com, en précisant l’objet de la demande et en justifiant de son identité si nécessaire.
Réclamation : auprès de la CNIL, www.cnil.fr.
ARTICLE 16 – Loi applicable et règlement des litiges
Le présent règlement est soumis au droit français, sans préjudice des dispositions impératives de protection des consommateurs applicables dans le pays de résidence du Participant.
En cas de litige, le Participant consommateur adresse d’abord une réclamation écrite à l’Organisateur à contact@utopieclub.com. En l’absence de réponse satisfaisante sous dix (10) jours, il peut recourir gratuitement à la médiation de la consommation, dans le délai d’un an à compter de sa réclamation, auprès du Médiateur du e-commerce de la FEVAD, 60 rue de la Boétie, 75008 Paris, www.mediateurfevad.fr, mediateurduecommerce@fevad.com.
En cas d’échec de la médiation, ou s’il ne souhaite pas y recourir, le Participant peut saisir les tribunaux compétents.
